Agreement to Terms

These Terms of Service ("Terms") are a legally binding agreement between you and Chinnovations ("we," "us," or "our") concerning your use of the Dark Tales mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Standard EULA Agreement

If you download the App from the Apple App Store, you also agree to Apple's Standard End User License Agreement (EULA) for licensed applications, available at apple.com/legal/internet-services/itunes/dev/stdeula.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Access and play the App for your personal, non-commercial use

This license does not include any resale or commercial use of the App or its mysteries; any redistribution, publication, or public performance of the App's content for profit; or any use of data-mining, scraping, or similar extraction tools.

No Account Required

Dark Tales does not use accounts or sign-in. Your favourites, play history, and settings are stored only on your device and are never sent to us. For details, see our Privacy Policy.

Content & Suitability

Dark Tales is a lateral-thinking mystery game. Many of its mysteries are inspired by real crimes, accidents, and historical deaths, and may include descriptions that some players find disturbing. The App is intended for a mature audience and is not directed at young children. Parental discretion is advised.

The mysteries are provided for entertainment only. While "real" mysteries are based on documented events, historical accounts can be incomplete or disputed, and we make no guarantee as to their accuracy. Nothing in the App is intended as factual, legal, medical, or professional advice.

Prohibited Activities

You agree not to:

• Copy, modify, or create derivative works of the App or its mysteries
• Reverse engineer, decompile, or disassemble the App
• Extract, republish, or redistribute the App's stories or artwork
• Remove any copyright, trademark, or other proprietary notices
• Transfer or sublicense the App to any third party
• Use the App for any illegal or unauthorized purpose
• Use automated systems or software to extract data from the App

Intellectual Property Rights

The App and its contents — including the written mysteries, hints, solutions, artwork, fonts, design, and their selection and arrangement — are owned by Chinnovations and protected by copyright, trademark, and other intellectual property laws.

The underlying historical facts behind "real" mysteries are not owned by anyone and are drawn from public sources, which are credited within the App where applicable. Our particular retellings, artwork, and compilation of those mysteries remain our property.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHINNOVATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE APP.

Our total liability for all claims relating to the App shall not exceed the amount you paid for the App, or €50, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Chinnovations and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App or your violation of these Terms.

Termination

You may stop using the App at any time by deleting it from your device. We may suspend or discontinue the App, in whole or in part, at any time. All provisions of these Terms that by their nature should survive termination — including intellectual property, warranty disclaimers, and limitations of liability — shall survive.

Governing Law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, unless mandatory consumer law grants you the right to bring proceedings elsewhere.

Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will update the "Last Updated" date above. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

Severability & Entire Agreement

If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect. These Terms, together with our Privacy Policy, make up the entire agreement between you and Chinnovations concerning the App.
